REGULATIONS OF THE EASTHUNTERS.COM WEB SERVICE

§ 1
Introduction
1.   The hereby Regulations specify inter alia: general terms and conditions, the terms and conditions of use and operation of EastHunters.com Web Service, as well as types and extent of electronically supplied services in the scope of distance selling: publication of job offers, translations of company profiles, as well as profiles of private persons, model documents i.e. without the simultaneous physical presence of the parties, via a Web Service EastHutners.com.
2.   The Web Service is owned by HPP Group Spółka z ograniczoną odpowiedzialnością Spółka komandytowa with its registered office in Bydgoszcz at ul. Cieszkowskiego 22 lok.1 85-052 Bydgoszcz, entered in the Register of Entrepreneurs of the National Court Register under KRS no. 0000815802, NIP: 967-143-17-20, REGON: 384930744
3.   The Web Service is available via the Internet and the website https://www.easthunters.com, as the resource of electronic information and communication, as well as IT system.
4.   EastHunters.com renders Services in accordance with the Regulations and the binding Polish law, as well as the applicable relevant provisions of the European Union.
5.   The use of the Web Service may take place exclusively in accordance with the terms and conditions and within the scope indicated in the Regulations and annexes to the Regulations.
6.   HPP Group Spółka z ograniczoną odpowiedzialnością Spółka komandytowa makes the Regulations available to the User via the EastHunters.com Web Service prior to conclusion of any Service Contract. The User is not be bound by such provisions of the Regulations that have not been made available to the User in a manner described above. The Service Provider enables the User to acquire, reproduce and save the Regulations at any time free of charge.

§ 2
Definitions
The terms used in the hereby Regulations should be understood as follows:
1.   Regulations – the subject-matter document.
2.   Web Service: the hereby portal.
3.   Civil Code: Act of April 23rd, 1964, the Civil Code (i.e. Journal of Laws of 2017, item 459).
4.   The Act on Copyright and Related Rights: Act of February 4th, 1994 on Copyright and Related Rights (i.e. Journal of Laws of 2017, item 880).
5.   The Act on Provision of Services by Electronic Means: Act of July 18th, 2002 on Provision of Services by Electronic Means (i.e. Journal of Laws of 2017, item 1219).
6.   GDPR: Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27th, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation).
7.   Data Protection Supervisor: a natural person assisting data controller in implementation of duties regarding protection of personal data.
8.   Protection of Personal Data: legal regulations with regard to creation and use of personal data sets, as well as individual data, aimed at administrative and legal protection of the right to privacy.
9.   Service Provider: HPP Group Spółka z ograniczoną odpowiedzialnością Spółka komandytowa with its registered office in Bydgoszcz at ul. Cieszkowskiego 22 lok.1 85-052 Bydgoszcz, entered in the Register of Entrepreneurs of the National Court Register under KRS no. 0000815802, NIP: 967-143-17-20, REGON: 384930744
10.            User: a natural person or entity having full capacity to perform legal acts that makes use of the Web Service resources and services. Users are divided into three groups (Unregistered User, Candidate, Employer).
11.            Unregistered User – a person or entity having capacity to perform legal acts that within the functionality of the Web Server has got access to information, in respect of which having an account and logging in is not required.
12.            Candidate: a natural person having full capacity to perform legal acts, who after registering his account and logging in has got access to: his profile, job offers published by Employers, advice and articles published by the Service Provider.
13.            Candidate Profile: any data identifying the Candidate to the extent enabling presentation of his candidature for the selected job offer to an Employer.
14.            Employer: a person having full capacity to perform legal acts, who after registering his account and logging in has got access to: his profile, publication of job offers, model documents, advice and articles published by the Service Provider.
15.            Employer Profile: any data identifying the Employer to the extent enabling presentation of his job offer and enterprise to the Candidate.
16.            Logotype: graphical form of presentation of symbol and name of the company or other organisation.
17.            Trademark: any marking enabling to distinguish between the goods of one enterprise and the goods of the other enterprise and that may be presented in the trademark register in a manner allowing for specification of explicit and precise subject-matter of the granted protection.
18.            Services: any electronically supplied activities implemented by the Service Provider in favour of the Candidate or Employer, the scope and legitimation of which is specified by the hereby Regulations.
19.            Job Offer: offer of employment submitted by the Employer that is addressed to Candidates, for the purpose of acquisition of candidates for work.
20.            Translations: any translation services rendered by the Service Provider in favour of the Candidate or Employer within the scope of services paid out on the Web Service.
21.            Candidate’s Data Analysis: a service rendered by the Service Provider in favour of the Employer, consisting in the analysis of the Candidate’s data for the purpose of implementation of legalisation processes enabling employment of the Candidate on the territory of the Republic of Poland.
22.            E-mail Address: address of electronic mail required for registration and logging of Users.
23.            Login: User ID used when commencing work with the Web Service.
24.            Password – a security code, correct entering of which launches the User Profile.
25.            Registration Form – a form completed by Employer or Candidates for the purpose of creating their own profile.
26.            Newsletter and Notifications: information if the form of electronic letter sent to the User e-mail address.

§ 3
Terms and Conditions of Use of the Web Service by the Users

The terms and conditions of use of the Web Service by the Employer have been set out in Annex no. 1 to the hereby Regulations – “The terms and conditions of use of the Web Service”, which constitutes its integral part.

§ 4
EastHunters Newsletter and Notification
1.   Within the “Newsletter and Notifications” service, the Service Provider sends information in the form of electronic letter (e-mail) to Users, within the scope of services rendered through the Web Service via electronic mail, to the e-mail address submitted by Users in the course of registration, hereinafter referred to as “EastHunters Newsletter” or “EastHunters Notification”. The Newsletter and Notifications services are provided free of charge for an indefinite period of time.
2.   The Newsletter and Notifications addressed to the Employers include information regarding:
  1. Candidate applications for the job offers published by the Employers;
  2. Notices and messages from Candidates;
  3. Current promotions;
  4. Articles and advice published by the Service Provider;
  5. Updates of services rendered via the Web Service;
  6. Possible amendments to the Regulations.
3.   Newsletter and Notifications addressed to the Candidates include information regarding:
  1. Current vacancies published by the Employers;
  2. Changes in statuses of applications submitted by Candidates for the selected job offers;
  3. Notices and messages from Employers;
  4. Current promotions;
  5. Articles and advice published by the Service Provider;
  6. Updates of services rendered via the Web Service;
  7. Possible amendments to the Regulations.
 
4.   Clicking a link confirming registration results in adding the e-mail address of the User to the mailing list. The Service Provider will send Newsletters to the e-mail address provided and confirmed by the User.
5.   The Newsletter and Notifications service may by limited or deactivated by the User at any time by unchecking relevant options of sending Newsletter and Notifications.

§ 5
Termination or Withdrawal from the Service Contract
1.   Each Party has the right to terminate the Service Contract by electronic means.
2.   The Candidate or Employer has the right to terminate the Service Contract – regardless of its cost – by electronic means by independent removal of their Account. An Unregistered User terminates the Service Agreement by ceasing to use the services rendered by the Service Provider.
3.  Each Candidate or Employer shall have a period of 14 days from the conclusion of the Service Contract to withdraw from the Contract without specifying any reason and without bearing any costs. Withdrawal statement shall be submitted in writing to the Service Provider's address: HPP GROUP Sp. z o.o. Sp. komandytowa ul. Cieszkowskiego 22 lok.1 85-052 Bydgoszcz, Poland.
4.   The Service Provider has the right to terminate the Service Contract with immediate effect by electronic means in case of:
  1. violation by the Unregistered User, Employer or Candidate provisions of the hereby Regulations;
  2. receiving information by the User that the Candidate Profile is fake, unlawful, contrary to the accepted principles of morality or when it violates personal rights of any third parties or legitimate interests of the Service Provider.
5.   The Service Provider is obliged to inform about termination of the Service Contract within 7 days from fulfilment of relevant conditions or performance of activities.
6.   The Service Provider reserves the right to refuse performance of Services in favour of the Candidate or Employer, including deletion of their account if it was set up once again after previous deletion by the Service Provider, resulting from infringement of the hereby Regulations.

§ 6
The Liability of the Service Provider within the Scope of Operation of the EastHunters.com Web Service
1.   The Service Provider is obliged to ensure that the Web Service operates in a continuous manner. The Service Provider will inform the Users about any technical interruptions and their duration, if possible, by any means available to the Service Provider, in particular by publishing relevant information and notices.
2.   The Users are not entitled to any claims for indemnification/compensation in relation to occurrence of technical interruptions in the operation of the Web Service, unless they stem from intentional fault or negligence of the Service Provider.
3.   The Service Provider is not liable for the content, veracity, correctness, completeness or form of the materials published by the Users on the Web Service. The content and form of the materials does not reflect the opinions or views of the Service Provider.
4.   The Service Provider has the right to carry out inspections of the materials published by the Users on the Web Service in terms of their compliance with the Regulations. For this purpose the Service Provider may also introduce proper solutions to the Web Service that perform the above-mentioned inspections in an automated manner.
5.   The Service Provider is not liable for the effectiveness of recruitment of Candidates, which depends exclusively on the Employer Profile and job offers submitted by the Employer addressed via the Web Service to Candidates.
6.   The Service Provider is not liable for damages in respect of the Employer when:
  1. the deadlines specified in Annex no. 1 “The terms and conditions of use of the Web Service” are not met by the Service Provider due to occurrence of technical interruptions within the operation of the Web Service, unless they stem from intentional fault or negligence of the Service Provider; as well as caused by any third parties, being in a contractual relationship with the Service Provider.
  2. the Candidate recruited via the Web Service inter alia: fails to fulfil any obligations established by the Employer, fails to appear at work or for a job interview, fails to take up employment, fails to complete relevant questionnaires necessary for the employment or breaks contact with the Employer.

§ 7
Processing of Personal Data
1.   The Personal Data Controller is: HPP Group Spółka z ograniczoną odpowiedzialnością Spółka komandytowa with its registered office in Bydgoszcz at ul. Cieszkowskiego 22 lok.1 85-052 Bydgoszcz, entered in the Register of Entrepreneurs of the National Court Register under KRS no. 0000815802, NIP: 967-143-17-20, REGON: 384930744;
2.   The contact with the Personal Data Supervisor should be made by electronic means to the following e-mail address: iod@easthunters.com
3.   The detailed principles, objectives and other provisions regarding the processing of personal data have been set out in Annex no. 2 to the hereby Regulations, which constitutes its integral part.

§ 8
Terms and Conditions for Publication of Advertisements
1.   Publication of advertisements in the Web Service is chargeable.
2.   The price of advertisement is established individually by the Service Provider for every order.
3.   It is possible to grant discounts and rebates established individually for every Advertiser.
4.   It is prohibited to publish advertisements with the content infringing the law or accepted principles of morality.
5.   Information of an advertising or promotional nature published by Unregistered User/Employee of Employer without the consent of the Service Provider will be immediately deleted.

§ 9
Complaints
1.   Any complaints regarding the Services rendered via the Web Service and the mode of its operation should be reported by mail to the address of the registered office of the Service Provider or by e-mail to the following address: admin@easthunters.com.
2.   A lodged complaint will be deemed to be a properly filed complaint if it contains:
  1. designation of an entity lodging a complaint (name, surname or company, place of residence or registered office address, e-mail address);
  2. subject-matter of the complaint;
  3. circumstances justifying the complaint.
3.   The complaints will be examined by the Service Provider within 30 days from the date of lodging such a complaint. In the cease of necessity of supplementing a complaint, the deadline for its examination should run from the date of service, also by means of direct remote communication, of the last required document or provision of the last required information. The complaint will be examined based on the hereby Regulations.
4.   Any decisions of the Owner of the Web Service with regard to complaints will be made by the Service Provider in writing, however they will be delivered in electronic form (e.g. scan) by means of e-mail.
5.   The right to seek redress before the common court with regard to complaints resulting from Services rendered by the Service Provider by electronic means will be granted after having exhausted the complaint procedure. The Service Provider also provides for the possibility of using consumer mediation conducted by persons or entities appointed to mediation.

§ 10
Amendments to the Regulations
1.   The Service Provider has the right to amend the terms and conditions of use of the Web Service by amending or updating the Regulations. It may take place particularly when:
  1. on the basis of the changes in the universally binding law or acts of the judiciary or administrative authority at the place of performance of the Service, the Service Provider will be obliged to change the content of the Regulations;
  2. on the basis of the  changes in the technology of performance of the Service;
  3. organisational or formal and legal changes on the part of the Service Provider.
2.   Information about amendments to the Regulations will be provided by e-mail to the address made available by the User or by submission of clear and explicit information on the web pages of the Web Service. In both cases, at least 14 days in advance the Amendments will enter into force on the date indicated in the information set out in the hereby paragraph.
3.   The Employer, Candidate and Unregistered User who fail to accept the Amendments to the Regulations have the right to terminate the Service Contract by electronic means.

§ 11
Final Provisions
1.   Any rights and obligations of the Parties are specified by the hereby Regulations, relevant regulations of the Polish law and relevant regulations of the European Union legislation.
2.   Provisions of the hereby Regulations do not violate any Consumer rights resulting from the binding legal regulations that apply in the first place, prevailing over the provisions of the Regulations.
3.   The Service Contract and Regulations shall be governed by the Polish law.
4.   Any Annexes to the Regulation constitute its integral part.
5.   For the matters not covered by the Regulations, regulations of the Act on Provision of Services by Electronic Means, Civil Code and other mandatory rules in law shall apply.
6.   Any disputes related to provision of Services based on the Regulations shall be settled by the Polish common court having jurisdiction over the registered office of the Service Provider.

ANNEX NO. 1
TO THE REGULATIONS OF THE EASTHUNTERS.COM WEB SERVICE
“TERMS AND CONDITIONS OF USE OF THE WEB SERVICE”

§ 1
General terms and conditions
1.   The use of the Services rendered via the Web Service takes place in accordance with the applicable law, provisions of the hereby Regulations, other regulations regarding the specific services available on the Web Service, also including the rules of promotions that constitute special provisions in relation to the hereby Regulations. The User making use of the services available on the Web Service is obliged to:
  1. refrain from any acts that could hider or interrupt operation of the Web Service and using the services available on the Web Service in a manner burdensome for other Users;
  2. provide authentic personal data – it is unacceptable to create accounts for non-existent Users, as well as to provide personal data of other people as one’s own data and use accounts of other Users or make one’s own account available to other Users;
  3. comply with economic copyrights and related rights and the rights resulting from registration of trademarks, utility and industrial designs, inventions and patents of any third parties;
  4. update the one’s data made available within the Web Service;
  5. get familiar with the amendments of the hereby Regulations and other regulations regarding the specific services available on the Web Service.
2.   It is unacceptable to publish on the Web Service, provide via the Web Service, including within any descriptions, job offers, forum (if operates) the content of the text, graphic and sound materials – also including links (hyperlinks) to such content – contrary to the applicable law and accepted principles of morality, promoting racial, religious or ethical hatred or propagating violence, encouraging the commission of offences, as well as vulgar content, generally recognised as morally reprehensible, socially improper, rude, violating personal interests of other Users, as well as unauthorised use of someone else’s image, infringing good morals and the rules of etiquette and any other acts that could expose the Service Provider to legal liability or that could harm the Service Provider.
3.   Any acts related to the use of information received via the Web Service connected to other entities and acts consisting in the use of any function of the Web Service for sending and publishing unsolicited marketing content, including commercial content on the Web Service is unacceptable.
4.   It is prohibited to publish or promote on or via the Web Service the following in particular:
  1. untrue information, in particular: fake job offers, fake Candidate Profiles, etc;
  2. any links (hyperlinks) referring to other websites, excluding the places intended for this purpose;
  3. software covered by rights of any other parties – without the proper authorisation;
  4. software intended for unauthorised damage, modification, removal, destruction, obstruction of access to IT data, serious interruption or prevention of automatic processing, collection and submission of such data, interruption of the operation of IT systems and networks;
  5. computer passwords, access codes or other data enabling unauthorised access to the information stored in the computer system or IT network.
5.   The Users publish contents on the Web Service on their own responsibility. The Service Provider has the right to delete or moderate the content that he deems to be unlawful or contrary to the Regulations, as well as the right to block the Users who notoriously violate provisions of the Regulations.
6. Prices for the payable services provided to Users have been set out directly next to the specific services, also sold within packages.
7. Prices of the specific services provided to the Employers and Candidates have been expressed in gross rates in Polish zlotys and include all the price components.
8. The User may make a payment using the e-payments system. Credit card and e-payment transactions are settled via Dotpay.pl. Charges for electronic payments will be borne by the Service Provider.


§ 2
Terms and conditions of use of the Web Service by an Employer
1.   A User willing to set up an Employer's account is obliged to submit the following data during the registration process:
a.   Value added Tax Identification Number (NIP),
b.   Full company name (in accordance with corresponding registers),
c.   e-mail address to serve as the account login,
d.   Representative's full name ( of the person authorised to set up the account in the Web Service)
e.   First language, used for communication purposes,
f.    Password (and its repetition)
and accept obligatory provisions regarding: familiarizing oneself with the Regulations contents and its acceptance, acknowledging the purposes of processing of personal data and consent to processing of personal data for the stated purposes.
2.   Having provided the abovementioned data, an activation link will be sent to the email address provided during the registration process. The link must be clicked in order to activate an Employer's account. The account is available for use once activated and grants all the functionalities provided via the Service.
3.   Having fully activated and logged into one's account, the Employer shall  complete the following company registry data in  My account - My data section:
a. Country,
b. Region,
c. City,
d. Postal code,
e. Street name
f. House and apartment number,
g. Phone number,
h. National Business Registry Number (REGON),
i. Register Entry Number (if applies)
4.   The Employer may also publish information regarding:
a. company web address (paid option)
b. company description,
c. providing company logo.
5.   The Service Provider renders the following services in favour of the Employer via the Web Service:
a.      publication of job offers for the purpose of searching for proper candidates for work;
b.     translation of job offers to the selected languages available within the service;
c.      refreshing one offer for the following 7 days;
d.     refreshing one offer for the following 14 days;
e.      publication of company descriptions (company profile);
f.      translation of company profile to the selected languages available within the service;
g.     access to model documents for the contractor in the Polish-Ukrainian or Polish-Russian version in the form of editable files (doc) for multiple use. Please note that the use of exemplary model documents will not substitute legal advice and the necessity of tracking changes in legal regulations. The made available exemplary model documents are created with the utmost care. Nevertheless, information is only of a general nature (illustrative purposes) and should not be construed at legal advice. The service Provider is not liable for completeness of such information. Please be advised to contact a lawyer in a situation when it is necessary to obtain legal advice making allowance for individual needs of the User.
h.     access to advice with regard to public administration containing the rules for legalisation of work of foreigners;
i.       access to articles useful when employing foreigners;
j.       making available of the link to the Employer’s company website in its profile description enhancing the effectiveness of recruitment;
k.     publication of the Employer’s trademarks, particularly company Logotypes, aimed at distinction of the Employer from other Users. Acceptance of the Regulations means granting the Service Provider a free-of-charge, non-exclusive and unlimited licence by the Employer for use of the Employer’s trademarks by the Service Provider, particularly his logotypes, by their publication for marketing purposes on the Web Service in the tab/section “They trusted us”.
l.       creating gallery of 5 photos of workplace;
m.   creating gallery of 5 photos of accommodation.
6.   The above-mentioned services will be available to the Employer against payment within the ordered packages or separately purchased single services.
7.   Any payable translations will be implemented by the Service Provider within 2 working days from the moment of applying for translation. Translated profiles and offers will be published on the websites of the Web Service within 2 working days after being translated.
8.   Effectiveness of the published job offers resulting in inflow of applications on the part of the Candidates depends on many factors attributable to the Employer, such as: offer attractiveness, place of work performance, opinion on the Employer and many others that lie beyond the control of the Service Provider. Therefore the Service Provider of the services rendered via the Web Service is not liable for effectiveness of the job offers published by Employers.

§ 3
Terms and conditions of use of the Web Service by a Candidate
1.   A User willing to set up a Candidate's account is obliged to submit the following data during the registration process:
a. E-mail address to serve as the account login,
b. Representative's full name ( of the person authorised to set up the account in the Web Service)
c. First language, used for communication purposes,
d. Password (and its repetition),
and accept obligatory provisions regarding: familiarizing oneself with the Regulations contents and its acceptance, acknowledging the purposes of processing of personal data and consent to processing of personal data for the stated purposes.
2.   Having provided the abovementioned data, an activation link will be sent to the email address provided during the registration process. The link must be clicked in order to activate a Candidate's account. The account is available for use once activated and grants all the functionalities provided via the Service.
3.   Having fully activated and logged into one's account, the Candidate shall  complete the following registry data in  My account - My data section:
a.   Street name,
b.   House and apartment number,
c.   City,
d.   Postal code,
e.   Country,
f.    Skype, WhatsApp or Viber number (optional),
g.   Phone numer.
4.   In order to increase one's possibilities of finding a suitable employment offer, the Candidate may also publish information constituting his CV regarding:
a. Work experience,
b. Skills,
c. Knowledge of foreign languages,
and can also upload his photo and CV file in pdf, doc, docx and odt formats.
5.   The Candidate whose application(s) has/have been accepted by the Employer(s) in order to use all the functionalities provided by the Service, shall complete his profile with the following data:
a.   Gender,
b.   Date of birth,
c.   Place of birth ( Country, region, city),
d.   Citizenship,
e.   Country of origin,
f.    Address of residence,
g.   Father's and Mother's names,
h.   Passport details: number, issue and expiry date 
i.    Authority issuing the passport,
j.    Passport scan,
k.   Optionally, the Candidate may complete his data regarding employment legalization:
  • Visa details (number, expiry date, issuing authority, scan)
  • Residency card details (number, expiry date, issuing authority, scan)
  • National Identification Number PESEL (if assigned)
6.   The Service Provider renders the following services in favour of the Candidate via the Web Service:
a.      creation of the Candidate Profile in the scope of professional experience, education, skills and foreign language competence;
b.     searching for job offers and submitting applications for the selected job offers;
c.      access to advice in the scope of administration covering the terms and conditions of legalisation of work foreigners;
d.     access to articles useful when searching for work on the EU territory;
e.      translation of Candidate’s professional experience to the selected languages available within the service.
7.   The above-mentioned services will be available to the Candidate free-of-charge or against payment in the scope of the purchased single services.

§ 4
Terms and conditions of use of the Web Service by an Unregistered User
1.   The Unregistered User may use the content and services available on the Web Service in a manner limited by the Service Provider. The majority of content, articles and advice and all the chargeable and free-of-charge services will be available only for the Unregistered User (Employer or Candidate).
2.   Complaint procedure in the case of Unregistered User. The Unregistered User will be entitled the right to lodge a complaint with regard to refusal of registration for the Web Service or setting up an account.

ANNEX NO. 2
TO THE REGULATIONS OF THE EASTHUNTERS.COM WEB SERVICE
”THE PURPOSE OF PROCESSING OF PERSONAL DATA”

1.   Personal Data Controller.
The Personal Data Controller is: HPP Group Spółka z ograniczoną odpowiedzialnością Spółka komandytowa with its registered office in Bydgoszcz at ul. Cieszkowskiego 22 lok.1, 85-052 Bydgoszcz, entered in the Register of Entrepreneurs of the National Court Register under KRS no. 0000815802, NIP: 967-143-17-20, REGON: 384930744;
Compliance with the terms and conditions for the protection of personal data in HPP Group Spółka z ograniczoną odpowiedzialnością Spółka komandytowa is supervised by the appointed Personal Data Supervisor, who may be contacted by sending a message to the following e-mail address iod@easthunters.com
2.   Collection and processing of data necessary for implementation of services and setting up a User account.
We collect personal by contacting us (e.g. by a contact form or e-mail). Mandatory fields are designated since the data contained therein are necessary for us to:
  1. a.   implement the service rendered via the Web Service or examine a matter, in relation to which the User contacted us;
  2. b.   set up a User account.
Without submission of such data no order for services rendered via the Web Service may be placed or no account may be set up or no contact may be made with us. The type of the data gathered results from the forms, to which the data are entered. We use the personal data provided by the User to perform the contract and to answer the User’s inquiries. After performance of the contract or deletion of the account by the User, processing of personal data will be restricted, and after expiry of storage periods specified in tax regulations and the accounting act the data will be deleted, unless the User gives his explicit consent to further use of such data for any other purposes. User account may be deleted at any time. For this purpose a message will be sent to the address of the Personal Data Controller ado@easthunters.com or a proper function in the User account will be used.
3.   Purpose of data processing.
The Service Provider renders a number of services via the Web Service in favour of third parties, implementation of which requires processing of personal data pursuant to Art.6 Par.1 GDPR. Within the scope of:
1.   handling the User we process personal data for the purpose of registration of the User and implementation of the contract. The processing is necessary for performance of the contract, to which the data subject is the party or for undertaking actions at the request of the data subject, prior to conclusion of the contract. Data will be processed until the moment of termination of cooperation or after 2 weeks from registration, if the User failed to accept registration on the Web Service;
2.   rendering the Notifications and Newsletter we process the data of Users for the purpose of sending notifications with regard to the Employer or Candidate, information about activities on the Employer or Candidate profile, as well as sending notifications to Candidates about new job offers and to all the Users about new services rendered by the Service Provider via the Web Service. Data will be processed until the moment of withdrawal of consent by the data subject or after 2 weeks from subscription, if the subscription of notifications or newsletter has not been accepted.
3.   searching for the new Users – by means of direct marketing – we process personal data for the purpose of acquisition of new Users of the Web Service, which is in the legitimate interest of the Service Provider. Data will be processed until the moment of raising effective objection in relation to processing of personal data by the data subject.
4.   receiving and examining complaints from Users of the Web Service and from potential customers we process personal data for the purpose of implementation of the legal obligation and performance of the contract. Data will be processed for 10 years from the moment of receipt of the complaint and in the event of a dispute, until the moment of its settlement, making allowance for proper periods for limitation on the validity of the claims.
5.   enforcement of claims and undertaking actions with collection nature we process personal data for the purpose of enforcement of claims, which is in the legitimate interest of the Service Provider. Data will be processed until the moment of settlement of the dispute, and in the event of settlement of liabilities (repayment) for the period of 6 years from the end of the year, in which the obligation constituting the subject-matter of the contested contract expired.
4.   Submission of data.
Recipients of the personal data of the Users of the Web Service include:
  1. HPP Group Spółka z ograniczoną odpowiedzialnością Spółka komandytowa;
  2. entities rendering services in favour of the Web Service (particularly in the scope of handling the IT system and hosting service providers);
  3. entities authorised to receive data based on legal regulations.
For the purpose of implementation of the services rendered via the Web Service the Employer will be provided with the personal data of the Candidate, which is necessary due to the specificity of the rendered Services. Depending on which provider of payment services will be chosen by the Users for implementation of payments for the solicited services, we submit the personal data collected for this purpose to the institution handling the payments and possibly to the provider of payment services chosen by us or the User. Some providers of payment services collect data independently, if Users have accounts set up with them. In such situations it is necessary within the order to log into the provider of payment services selected in the course of the process of placing an order by providing one’s access data. In such cases the Privacy Policy of the given provider of payment services also applies.
5.   The rights entitled to the User with regard to the processing of personal data
1.   Right of access to personal data. Every User has the right to obtain confirmation from the Service Provider whether we process his personal data. Every User has the right to be granted access to his personal data. Every User has the right to obtain information about processing purposes, categories of the personal data processed, about recipients or categories of recipients of such data, planned storage period of his data or criteria regarding specification of such a storage period, about any rights entitled based on GDPR and the right to lodge a claim to a supervisory body about the source of such data, about automated decision-making, including profiling and about safety measures used in relation to provision of such data outside the European Union.
2.   Right to restriction of processing of data. Every User has the right to request restriction of processing of personal data. In the event of reporting such a request, the Service Provider may restrict or prevent the use of the specific services or functions of the Web Service, using of which would entail processing of the data covered by the request. The request to restrict data processing will also result in suspension by the Service Provider of sending notifications, newsletters and other messages to the User, including the marketing ones. The User is entitled the right to request restriction of processing of personal data when: the User questions the correctness of processing; processing of the User’s data takes place with violation of the law; personal data of the User are no longer necessary for the purposes, for which they have been collected and used, but they are needed for the User to establish, exercise or defend legal claims; the User raised objection to the processing of his personal data.
3.   Right to withdraw consent for the processing of data. The withdrawal of the consent takes effect upon the moment of such a withdrawal, but has no influence on the processing of the User’s data by the Service Provider before the withdrawal. The withdrawal of the consent may prevent or restrict further use of the services of the Service Provider by the User.
4.   Right to object to the processing of data. Every User has the right to object to the processing of his personal data, if such data are processed based on legitimate interest of the Service Provider. If the raised objection is justified and the Service Provider has no other legal basis to process the personal data of the User, the data covered by the objection will be deleted.
5.   Right to erasure of data. Every User has the right to request erasure of all or some of his personal data, if: the personal data of the User are no longer necessary for the purposes, for which they have been collected or processed; the User raised the objection to the use of his data for marketing purposes; the User raised the objection to the use of his data, and when his objection was deemed to be justified; the personal data of the User are unlawfully processed.
6.    Right to rectify personal data. Every User may independently rectify and supplement his personal data. It may be made after logging into the User Account.
7.   Right to personal data portability. Every User has the right to receive his personal data that he submitted to the Service Provider and then transmit them to a different, independently selected personal data controller, e.g. to a different provider of similar web services. The User has also the right to request that his personal data are sent to a different personal data controller directly from our Web Service, if technically possible.
8.   Right to lodge complaints. As far as the User considers that his rights to protect his personal data or other rights entrusted to him in accordance with GDPR have been violated, he has the right to lodge a complaint with the President of Personal Data Protection Office.

6.   Obligation to submit personal data.
Submission of personal data by the user is voluntary, but necessary to use the services rendered by the Service Provider via the Web Service. Failure to submit or submission of incomplete personal data will result in the lack of access to Services or restricted access.
